By using Hostrina Kenya services, you acknowledge that you have read our legal documents and agree to be bound by the terms and conditions contained herein, as well as all acceptable use policies incorporated by reference.
Uniform Domain Name Dispute Resolution Policy (UDRP)
(As approved by ICANN on October 24, 1999)
1. Purpose
This Uniform Domain Name Dispute Resolution Policy (“Policy”) is adopted by the Internet Corporation for Assigned Names and Numbers (“ICANN”) and incorporated into your registration agreement. It governs disputes between you and any party other than us (the registrar) regarding the registration and use of your domain name. Proceedings are conducted according to the Rules for Uniform Domain Name Dispute Resolution Policy.
2. Your Representations
- All statements in your registration agreement are complete and accurate.
- Your domain registration does not infringe on the rights of any third party.
- Your registration is not for any unlawful purpose.
- You will not use the domain in violation of any laws or regulations.
3. Cancellations, Transfers, and Changes
We will act upon:
- Written or electronic instructions from you or your authorized agent.
- A court or arbitral order of competent jurisdiction.
- A decision from an ICANN-approved Administrative Panel.
4. Mandatory Administrative Proceedings
You must submit to a mandatory administrative proceeding if a complainant asserts that:
- Your domain is identical or confusingly similar to their trademark.
- You have no legitimate interests in the domain.
- The domain has been registered and is being used in bad faith.
The complainant must prove all three elements.
a. Evidence of Bad Faith
- Registering a domain primarily to sell or transfer it for profit.
- Preventing the trademark owner from using their mark in a domain name.
- Disrupting the business of a competitor.
- Creating user confusion for commercial gain.
b. Legitimate Interests
- You used or prepared to use the domain for bona fide offerings before notice of dispute.
- You are commonly known by the domain name.
- You make legitimate noncommercial or fair use without intent to mislead.
c. Administrative Panel and Providers
Disputes are handled by ICANN-approved providers. The complainant selects a provider from the list at ICANN’s website. The process, fees, and rules follow ICANN’s standard UDRP procedures.
d. Remedies and Decisions
The Administrative Panel may order cancellation or transfer of your domain name. Hostrina Kenya does not participate in the proceedings or decisions.
e. Court Proceedings
Either party may submit the dispute to a competent court before or after UDRP proceedings. Implementation of panel decisions will occur ten (10) business days after notification unless a court case is filed.
5. Other Disputes
Any disputes not covered under this Policy must be resolved between the involved parties via arbitration or court proceedings. Hostrina Kenya will not participate in such disputes.
6. Transfers During a Dispute
- You cannot transfer a domain to another holder during an active dispute.
- You cannot change registrars during an ongoing UDRP proceeding.
- Any transfers made in violation of this policy may be canceled.
7. Policy Modifications
Hostrina Kenya reserves the right to modify this policy with ICANN’s approval. Any revisions will be published at least thirty (30) days before taking effect. Continued use of our services after changes indicates acceptance.
